Welcome to the dafinitive.com website (the “Site”), which is owned and operated by Helen Brown Group, LLC (“Helen Brown Group”, “HBG”, “we,” “us,” or “our”). This Privacy Policy describes how HBG may collect, use, and disclose information gathered from your use of the Services which includes, the Site, DAFinitive®, HBG’s database of information related to donor advised funds, and any and all materials in all forms and mediums provided by HBG and appearing on the Services (the “Content”), including Personal Information which is any information that relates to an identified or identifiable natural person, or as otherwise defined under applicable law (“Personal Information”). This Privacy Policy applies when you use and interact with the Services.

By using the Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Privacy Policy and consent to HBG’s collection, use and disclosure of Personal Information and Usage Information as set forth herein. If you do not consent to the terms of this Privacy Policy, you should not access or use the Services in any way and should immediately exit them.

We collect Personal Information and Usage Information that you provide to us, that we gather through automated means, and that information we obtain from other sources.

Information You Provide

We collect Personal Information and other information that you provide when you contact us through the Site, schedule a demo through Calendly or other scheduling software, sign up for a subscription, log in to your account or otherwise connect with us through the Services. Depending on why you are contacting us, the information collected could include:

  • Name;
  • E-mail address;
  • Phone number;
  • Organization;
  • Username;
  • Password;
  • Date of registration;
  • Payment information (last 4 of credit card number and expiration date);
  • Billing Address
  • Reason for contacting us;
  • Availability for scheduling purposes;
  • How you heard about us;
  • Information that you choose to store in your account.

Automatically Collected Information

By choosing to use the Services, you agree to provide HBG with certain information, including Personal Information, which is automatically created, collected, and recorded by your use of the Services (collectively “Usage Information”). HBG uses third parties, including Google Analytics and Paid Membership Pro, to collect Usage Information which may include Personal Information, as described below:

  • IP Address (or the proxy server you use to access the world wide web);
  • Device identification numbers;
  • Geolocation information;
  • Browser type;
  • Device type and settings;
  • Internet service provider and mobile carrier;
  • Pages and files viewed, time spent on them, and links clicked;
  • Websites you visited before and after visiting the Services;
  • Searches performed;
  • Operating system and system configuration information; and
  • Date and time stamps associated with your usage.

We may obtain certain of this Usage Information by installing a “cookie” on your device (or using a third party to do so) or using similar technologies such as pixels, web beacons, access logs, or software development kits that may forward such information to third parties. If you interact with us through a third-party (e.g. LinkedIn, Calendly), in addition to the information that you provide, we may obtain information about you that you have permitted those services to share with us consistent with your privacy settings for that third-party account.

How We Use Personal Information

HBG uses the information collected, including Personal Information, for a variety of purposes. For example, HBG may use Personal Information to:

  • Provide our service to you including registering your account and providing you with products and services that you have requested;
  • Respond to you regarding the reason you contacted us;
  • Provide you with additional information about our products and services;
  • Improve our marketing;
  • Better understand and respond to our audience;
  • Improve our products and services;
  • Send you our newsletter and other e-mails, including marketing e-mails;
  • Schedule a demonstration of our products and services with you;
  • Operate and improve the Services;

Email Address

If you provide us with your e-mail address, you authorize us to send you e-mails, including marketing e-mails, unless and until you request to unsubscribe from such e-mails. We may collect information regarding your interactions with our e-mails and newsletters, including your IP address, broad geographic location, and whether you opened the emails or newsletters or clicked on any links within them. If you no longer wish to receive e-mails from us, follow the “unsubscribe” instructions located near the bottom of each e-mail. If you unsubscribe, you will still receive transactional e-mails from us including responses to your inquiries.

Service Providers

We may share your Personal Information and Usage Information with certain trusted third parties, including Google Analytics, Paid Membership Pro, Stripe, and MailChimp, that we engage to perform functions and provide services to us, including, without limitation, payment processing, website management, database storage and management, customer relations and support, data analysis, and marketing and social media services.

Payment Processing

If you choose to make payment for our products or services, you will be directed to Stripe, a third-party payment processor, to provide a credit card number and other information, including Personal Information, needed to complete the transaction. Our payment processor will be certified to meet the industry standards for security and confidentiality, as well as applicable laws. You may receive e-mail communication from us and/or the payment processor regarding any payment transaction.

Scheduling A Demo

If you choose to schedule a demonstration of our products and services, you will be directed to Calendly, a third-party meeting scheduler, to provide the information, including Personal Information, required to complete the transaction. You will receive e-mail communications from Calendly regarding scheduling the demonstration.

Other Third Parties

We also may share your Personal Information and Usage Information with third parties as follows:

  • to satisfy any applicable law, regulation, legal process or governmental request;
  • to detect, prevent or otherwise address fraud, security or technical issues;
  • to prevent a crime or protect national security;
  • to protect the rights, property or safety of us, our users or others; or
  • in connection with a financing or a sale, acquisition, merger, restructuring or any other transaction involving a change of control in our business, including but not limited to a bankruptcy or similar proceeding.

We might disclose your Personal Information to third parties if you have consented to it or if there are other legal grounds for it.

Do Not Track

Some web browsers have a “Do Not Track” preference that transmits information to websites you visit indicating that you do not want your activity to be tracked. We do not respond to “Do Not Track” signals at this time as there is no standard for how online services should respond to such signals.

How Long Do We Keep Your Personal Information

We will retain your Personal Information for as long as necessary to fulfill the purposes for which it has been collected. We will also retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. HBG is not responsible for the practices and policies, including privacy practices and policies, of such third parties. Children

We do not intend for the Services to be used by children under the age of 18, nor do we intentionally collect or solicit any Personal Information from children under the age of 18. If you are under the age of 18, please do not provide us with any information and promptly exit the Services.

By accessing and using the Services, you acknowledge and agree that HBG controls and operates all parts of the Services from its offices in the United States of America.
